Arizona AZPDES Construction Stormwater: What Makes It Different

Arizona operates its own delegated NPDES program through the Arizona Department of Environmental Quality (ADEQ). The AZPDES Construction General Permit (CGP) is Arizona's primary mechanism for regulating stormwater discharges from construction sites disturbing one acre or more. While it tracks the federal CGP in most respects, Arizona has several state-specific provisions that catch operators accustomed to working in other states off guard.

The two most significant Arizona-specific factors: the monsoon season (June-September) creates a dramatically different precipitation and runoff pattern than the rest of the country, and ADEQ's enforcement program has been increasingly active in targeting construction sites in the Phoenix, Tucson, and Flagstaff metropolitan areas.


Who Needs AZPDES Coverage?

You need AZPDES Construction CGP coverage if your project:

  • Disturbs 1 acre or more of land in Arizona
  • Disturbs less than 1 acre but is part of a larger common plan of development that will ultimately disturb 1+ acres
  • Involves construction at a facility that already holds an AZPDES individual or general permit for industrial discharges (these facilities may have additional obligations)

Exemptions that apply under AZPDES (same as federal):

  • Routine maintenance of existing facilities within pre-established cleared areas
  • Agricultural activity exempted under CWA Section 402(l)(1)
  • Emergency response activity

How to Obtain AZPDES Coverage

Step 1: Develop Your SWPPP First

Like New Mexico, Arizona requires your SWPPP to be complete before you submit your NOI. The SWPPP must identify the receiving water(s) for stormwater discharges from your site. Arizona requires checking the following ADEQ databases before filing:

  • AZPDES permit database for nearby facilities
  • 303(d) impaired waters list for the receiving watershed
  • Arizona's Outstanding Waters and Outstanding Arizona Waters list

Step 2: Submit Your NOI via ADEQ's AZPDES Online Portal

Arizona NOIs are submitted electronically through ADEQ's Water Quality Division portal. Required information:

  • Facility/site name and address
  • Operator name and contact information
  • Project description including acreage of total disturbance
  • Receiving water identification
  • Estimated start and end dates
  • Certification statement

NOI Fee: Approximately $150 for sites under 10 acres; $400 for 10 acres and above. Check the current ADEQ fee schedule before filing.

Processing time: Generally 5-10 business days. Projects near impaired waters or Outstanding Arizona Waters may require additional review.

Step 3: Receive Authorization and Post Permit Number

Upon receiving your written authorization from ADEQ, post your AZPDES permit number at all construction entrances. You may not commence land disturbance until authorization is in hand.


AZPDES SWPPP Requirements: What Must Be in the Plan

The AZPDES CGP SWPPP requirements closely follow the federal standard with these Arizona-specific additions:

Monsoon Season Planning

Arizona's SWPPP must include specific provisions for the June-September North American Monsoon season, which is the period of highest precipitation intensity in most of Arizona. The SWPPP must:

  • Identify the monsoon season as a high-risk period
  • Describe enhanced BMP measures to be implemented before the monsoon season begins (typically by June 1)
  • Include a post-monsoon assessment protocol
  • Address flash flood potential for sites with any portion in a FEMA flood zone or drainage channel

Dust Control Integration

Arizona's construction sites must also comply with Arizona Department of Environmental Quality's air quality rules for fugitive dust (Arizona Administrative Code R18-2-610). While this is technically separate from the AZPDES SWPPP, ADEQ inspectors who find dust control violations on a site they are inspecting for AZPDES compliance will refer those violations to the air quality program. Integrated planning for both programs is strongly recommended.

Desert Wash Buffer Requirements

Sites adjacent to desert washes -- the ephemeral drainage channels that are ubiquitous in Arizona -- require specific BMP protection along the wash buffer. Arizona law (Arizona Revised Statutes Section 48-3612) and local ordinances in many municipalities set construction setbacks from designated washes. The SWPPP must identify all washes within and adjacent to the site and include specific BMP measures protecting these areas.


AZPDES Inspection Requirements

Routine inspections: At least every 14 calendar days.

Post-precipitation inspections: Within 24 hours of any precipitation event that results in stormwater discharge from the site. Note: Arizona uses "any discharge event" as the trigger, not a specific rainfall amount threshold. During the monsoon season, when convective storms can produce 0.5+ inches in under 30 minutes, this means post-storm inspections may be required multiple times per week.

Monsoon season inspection frequency: While the permit language states 14-day routine inspections, ADEQ has informally communicated that sites in higher-risk areas (near washes, steep terrain, impaired watersheds) should plan for weekly inspections during June-September. Documenting this enhanced frequency provides a strong compliance record if you ever face a Notice of Violation.

Inspector qualifications: ADEQ does not currently require a specific inspector credential, but the inspector must be knowledgeable about CGP requirements and the site-specific SWPPP. Names and qualifications must be recorded in the SWPPP.


Arizona-Specific BMP Requirements and Modifications

Standard BMP specifications apply in Arizona, but several modifications are necessary for the Arizona climate and soil conditions:

Wind Erosion Control

Arizona's desert winds -- particularly in the spring and during pre-monsoon season -- create significant wind erosion potential on disturbed sites. The AZPDES CGP requires wind erosion controls in addition to water erosion controls. This typically means:

  • Hydroseeding or surface stabilization for any disturbed area that will be exposed for more than 14 days
  • Dust palliative application on active grading areas

Revegetation Standards

Final stabilization in Arizona must meet a standard appropriate to the receiving watershed:

  • In arid areas: 70% of the pre-disturbance vegetation density, using species appropriate to the area
  • In urban areas: can meet with equivalent non-vegetative stabilization (pavement, riprap, etc.)
  • In Sonoran Desert landscape: native seed species required; invasive species prohibited

Arizona's revegetation standard is less prescriptive than New Mexico's but still requires documentation that final stabilization has been achieved before filing the Notice of Termination.

Sediment Basin Requirements

Sites with drainage areas exceeding 10 acres draining to a single point must have a sediment basin. Arizona follows the federal CGP's 1,800 cubic feet per disturbed acre storage volume standard. For arid areas where evaporation is a significant factor, ADEQ requires that basin storage calculations account for evaporative losses to ensure adequate volume during storm events.


ADEQ Enforcement: What Triggers an Inspection

ADEQ's construction stormwater enforcement program focuses on:

  1. Complaint-driven inspections: Citizens or adjacent landowners who observe sediment leaving a site and discharge it to a wash or drainage channel can file an ADEQ complaint that triggers a site inspection within 5-10 business days.
  2. New development area sweeps: ADEQ periodically conducts inspection sweeps in high-growth areas (currently Phoenix metro, Tucson metro, and Flagstaff area) specifically targeting construction sites.
  3. NOI cross-reference: ADEQ cross-references active NOI coverage against satellite imagery and satellite-based change detection to identify sites with land disturbance that may lack permit coverage.
